Terms of Service
These Terms explain the rules for using Angelya's website, app, publishing scheduler, API, MCP access, and related services.
1. Agreement to these Terms
These Terms of Service govern your access to and use of Angelya, a creator-first scheduling service operated by Simple Aura LLC. By creating an account, connecting a publishing account, using the API or MCP features, or otherwise using Angelya, you agree to these Terms.
If you use Angelya on behalf of a company, team, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use Angelya. If you are under the age of majority where you live, you may use Angelya only with permission from a parent or legal guardian who agrees to these Terms.
You are responsible for keeping your account credentials secure and for all activity that occurs through your account, API keys, connected agents, or connected social accounts.
3. Accounts and authentication
Angelya uses account authentication, email verification, and optional OAuth sign-in providers. You agree to provide accurate account information and to keep it current.
You may not share, sell, lease, or transfer your account in a way that creates security, billing, platform-compliance, or abuse risk. You must notify us promptly if you believe your account, API keys, or connected platform credentials have been compromised.
4. Subscriptions, trials, cancellation, and refunds
Angelya offers paid plans and optional add-ons. Billing, subscription management, checkout, and customer portals may be handled by third-party billing providers such as Autumn and Stripe.
If a plan includes a trial, you may cancel before the trial ends to avoid being charged. You can cancel a paid subscription through the billing portal. Cancellation stops future renewal, but access may continue through the current paid period.
Except where required by law, fees are non-refundable. Angelya may issue credits or refunds at its discretion on a case-by-case basis.
5. Your content
You retain ownership of the drafts, posts, media, schedules, metadata, and other content you submit to Angelya. You grant Angelya a limited license to host, process, store, copy, display, transmit, and publish your content as needed to provide and improve the service.
You are responsible for your content and for ensuring that you have all rights and permissions needed to upload it, schedule it, publish it, and authorize Angelya to process it.
Angelya does not use your drafts, scheduled posts, uploaded media, or connected account content to train third-party or general-purpose AI models without your permission.
6. Publishing and connected platforms
Angelya helps you prepare, schedule, and publish content to third-party platforms such as X and other supported platforms as they become available. Third-party platforms are not controlled by Angelya and may change their rules, APIs, limits, availability, or review processes at any time.
You are responsible for complying with each connected platform's terms, policies, community rules, advertising rules, rate limits, and content requirements. Angelya may refuse, pause, remove, retry, or block scheduled publishing that appears abusive, spammy, infringing, unlawful, unsafe, or likely to violate platform rules or harm the service.
Angelya does not guarantee that a platform will accept, display, rank, recommend, retain, or successfully publish any content.
7. API, MCP, agents, and automation
If you use Angelya API keys, MCP access, scripts, automations, or agents, you are responsible for all actions performed through those credentials and integrations.
You may not use automation to bypass plan limits, platform rules, security controls, billing requirements, or rate limits. We may rotate, limit, suspend, or revoke API keys or automation access to protect Angelya, users, connected platforms, or the public.
8. Acceptable use
You may not use Angelya to violate the law, infringe intellectual property rights, publish deceptive or harmful content, send spam, harass others, impersonate another person, distribute malware, scrape or attack the service, interfere with other users, or abuse connected platform APIs.
You may not reverse engineer the service, access it in a way that avoids normal security controls, or use Angelya to build a competing product by copying non-public functionality, interfaces, or data.
9. Service changes and availability
We may add, remove, limit, or change features, plans, integrations, APIs, and platform support. We try to keep Angelya reliable, but the service may be unavailable or degraded due to maintenance, infrastructure, platform API changes, third-party providers, outages, or events outside our control.
We may suspend or terminate access if we believe your use creates risk, violates these Terms, violates platform rules, creates billing or security issues, or could harm Angelya, other users, connected platforms, or the public.
10. Intellectual property
Angelya, including its software, design, branding, workflows, documentation, and non-user content, is owned by Simple Aura LLC or its licensors and is protected by intellectual property laws.
You may provide feedback, ideas, or suggestions. We may use that feedback without restriction or obligation to you.
11. Disclaimers and limitation of liability
Angelya is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, Simple Aura LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost content, platform enforcement, or business interruption.
To the fullest extent permitted by law, our total liability for claims related to Angelya will not exceed the amount you paid to Angelya in the three months before the event giving rise to the claim.
12. Indemnity
You agree to defend, indemnify, and hold harmless Simple Aura LLC from claims, damages, liabilities, losses, and expenses arising from your content, your use of Angelya, your connected accounts or automations, your violation of these Terms, or your violation of law or third-party rights.
13. Governing law
These Terms are governed by the laws of Texas, without regard to conflict-of-law rules. The courts located in Texas will have exclusive jurisdiction over disputes that are not required to be handled in another forum by applicable law.
14. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as by posting the updated Terms or sending an account notice. Your continued use of Angelya after the effective date means you accept the updated Terms.
